Rights as an Object of Analysis: Between Philosophy and Sociology

This article reflects, based on the distinction between human rights and fundamental rights, on the scope of the sociological approach to rights and on the difficulties it faces. Among these, the problems of conceptualization of rights and the complicated neutral approach to a reality with a high moral density, such as rights, stand out. Finally, the contributions that the sociology of rights can offer to their functional analysis are highlighted.
