Th e debate between evolutionism and creationism has recently reached once again the North American courts as the professors were required by the Dover Area School District, Pennsylvania, to read a statement to the students in the ninth grade Biology class in which it was affi rmed that the evolutionary theory set out by Darwin in Origin of Species isn’t the only reasonable explanation about life’s origin and changes, and in which the students were encouraged to inquire into some others, like the one proposed by Davies & Kenyon in Of Pandas and People. Th e present article exposes the historical, social and legal context in which the case Tammy Kitzmiller et al. vs. Dover Area School Disctrict developed, and displays a jurisprudence selection about Establishment Clause of the First Amendment of the United States Constitution, including brief commentaries about some institutions of U.S. Procedural Law applied in the sentence
