The current situation of families suggests an unfinished legal reality or, in other words, an still opened scenario, as it is being overwhelmed by facts and behaviours which have not been forecasted by legislator and claim for legal recognition. Reasons for that are the boost of fundamental rights, basically equality in both its formal and substantial dimensions, freedom and free development of personality. We should also mention of the changes in the women
roles, the importance of maternity and paternity wills, the minors greater autonomy, a intensified parental circle extended to grandparents and other close relatives, and affective links emerged in complex families. Other circumstances should also be considered such as the scientific progress, the internationalisation of family relationships and the multicultural aspect of the contemporary societies
