Abstract

Th is paper looks into the classic identifi cation among family and marriage, as the main way to establish family relationships. It reviews the identifi cation and bankruptcy which takes place with the forms of cohabitation that have been introduced and that start with the concept of nuclear family as the basic element of the new family model from economic and legal relations result of the new order created by the French Revolution. Th is article examines some marriage components; it points at new models of marriage, and it concludes that is necessary to arrange family relationships over two basic axes: on the respect of the fundamental rights of its members and their agreement, getting away stereotyped forms. It does not preclude the right of those who must provide the social benefi ts of demanding security that the form provides
