THE PRETENDED DOUBLE QUALIFICATION OF PAPERS NOTARIALS SUBJECT TO INSCRIPTION

Abstract

Th e protection of the Spanish land registry and business register is only available for publics certifi cates made of a professionals similar to the solicitors o barristers who also advise around the law applied to the agreement. But it is not enough to allow the entry in a Register System. It also requires a positive “qualification” about the validity of the agreement. Then, there are two different opinions about the same question. This special situation is generating a big tension in the economic traffic because the doubts about which is the preferential opinion make uncertainty. Th is paper aims to clear the competences and functions of both of these civil servants.
