Abstract

During the last few decades there has been debate on whether (higher) animals have basic rights. It is pertinent here to focus on language function and on facts that particularly neuroscience off ers. Basing our arguments on E. Tugendhart and on A. Kenny, we propose a synthesis that takes into account the similarities and the differences between (higher) animals and humans. Th e similarities are due to our proximity on the evolutionary tree. The differences are due to animals lacking a predicative language such as that of humans. The conclusion is a gradualist overview. We might not put humans and animals on a level in relation to rights, but we should respect their good by avoiding suffering.
