Abstract

When a dissociation is produced in a person between the biological or genetic factor of gender and the psychosocial sexual reality in which he is living and feeling, a breach takes place in his sexual identity; is what medicine and official sexology describe as transsexualism or dysphoria gender. Against the general thought, this problem doesn’t only show up in adulthood, children also suff er from this disorder, with the related emotional, social and other impacts. The purpose of this study is to examine how our legal system provides for transsexualism in the underaged, especially in adolescence. Our study will allow us to verify the absence of legal response to a human problem that, despite its low incidence, is a social and scientific reality that clearly needs a specifi c regulation to provide legal certainty
