Abstract

Th e relativization of the so called “exclusionary rule” of illegal obtained evidences through a judicial “balancing test”, forget the perspective introduced by the Article 24. 2 CE on the right to due process what is guaranteed, among other guarantees, through the article 11.1 LOPJ referenced at this work. Only a legally regulated system of exceptions, can develop this essential aspect of that fundamental right.
