Abstract

This essay is a critical evaluation over the foundations of posititivist and postpositivist legal theory in Ferrajoli, Habermas and Alexy. The conclusion is a doubt over the status and validity of General Theory of Law and a replacement of reason. This replacement goes from the theoretical to practical reason, From the Reason to the reasons, from the Great Theory to the little histories and, theories and, finally, from the coactive arguments to persuasive ones.
