Abstract

This article analyses the treatment that the European Court of Human Rights (ECHR) holds for freedom of expression in the field of political criticism. The main objective is to highlight the differences between European and domestic jurisdiction in some cases where the position of the ECHR is much more favorable to the effectiveness of the fundamental right concerned. The work defends the need to respect the canon of the ECHR in order to exclude from the orbit of criminal law the borderline cases
