BANKRUPTCY AND EMPLOYMENT CONTRACT…, TOO MANY QUESTIONS

Abstract

Th is study is aimed to open new ways for refl ection and debate on the complex questions related to the labour interests’ protection aff ecting the insolvency proceedings. Th ere are some questions which have not been solved yet, like the classic debate about the preference between the creditors’ interest and the company’s safeguard; the fact that the insolvency’s regulation has been built in Spain related to the labour regulation; the extension and guarantees of the social credits within the insolvency process; and, fi nally, the real effi cacy of the rules regarding the company’s transfer. All these matters are studied here and some proposals for reform are given.
