A reckless asset. Elements of a legal-philosophical approach to digital disruption

Abstract

In the next lines we present the essential elements to analyze disruptive information technologies (IA, Big Data). First, we describe the legal and social-economical context of the contemporary technological development. With that aim, we tackle the fragmentation of contemporary law and the transformation of the Nation-State structure (Cutler; Mercado Pacheco, Zumbansen). Secondly, we consider the essential definitions and philosophical elements of this technologies. Here we analyze its characteristic description (Delipetrev, Tsinaraki et al.) and its elementary metaphysical elements (Joque, Pasquinelli). Following to that, we analyze the present of technology law (Gutiérrez García, Hernández Peña). We also consider, in a geopolitical way, the policies of technology being carried through by the USA, China, and the Europea Union. We conclude with some critical considerations.
