Judicial independence and the principle of legality. Analysis of the case of Gutiérrez Navas et al. v. Honduras

Abstract

This article analyzes the case “Gutiérrez Navas et al. v. Honduras”, decided by the Inter-American Court of Human Rights, which deals with the arbitrary and illegal dismissal of four judges of the Constitutional Chamber of the Supreme Court of Justice of Honduras. Using a qualitative methodology with a documentary analytical approach, the study examines the background of the case, the proven facts, the human rights violations identified by the Court, the partial recognition of responsibility by the State, as well as the measures of integral reparation and non-repetition. The research highlights the importance of judicial independence and offers recommendations to strengthen the rule of law and independent justice in Latin America.
